Worker's Compensation - Injured on The Job

New Jersey law provides that an employee injured in the work place is entitled to compensation from the employer including payment of lost wages and medical expenses due to the accident, and additional compensation if the injury is permanent.

The law does not require the employee to prove that the injury was the employer’s fault. Simply showing that the injury occurred at the work place is sufficient to entitle the employee to compensation.

Where the accident occurs due to the negligence of someone other than the employer or the employee, (e.g., an employee making a delivery is injured in a car accident or an employee cutting lumber is injured by a defective saw blade), the employee may seek additional compensation for the injuries, pain and suffering.

Michael Hoffman, the firm’s lead trial attorney, recently settled a case for $500,000 for injuries sustained by a construction worker at the job site. Our client’s employer paid the employee’s lost wages and medical expenses. Then, a third party who failed to properly place temporary sidewalks on the work site paid for recovery of the extensive damage to our client’s knee.

Mr. Hoffman litigates cases for individuals who have suffered injuries both on the job and off the job.
